These terms apply when you use KULTXR (kultxr.com) and the KULTXR portal (kultxr.com/portal), which are operated by KULTXR, Inc., a Nevada corporation (“we”, “us”). By using the site or the portal you agree to them.
Portal accounts
Portal accounts are created by invitation. Keep your sign-in details to yourself; what is done under your account is your responsibility, so tell us straight away if you think someone else has used it. We may suspend an account that is misused or that is no longer needed. Where your organisation has a separate written agreement with us, that agreement governs your use of the portal wherever it differs from these terms.
Our content and marks
The site’s design, text, images and the names and logos of our brands are our intellectual property or used with permission. You may not copy or reuse them without our written permission. Third-party trademarks shown on the site belong to their owners.
Using the site
Do not misuse the site or the portal: no attempts to break or overload them, to access accounts or data that are not yours, or to use them for anything unlawful.
Warranties
Apart from any warranty the law gives you that cannot be excluded, the site, the portal and their content are provided “as is”, and we do not warrant that they will be uninterrupted or error-free.
Limitation of liability
To the extent the law allows, we are not liable for indirect or consequential loss, and our total liability to you for any claim about the site or the portal is limited to the amount, if any, you paid us in the 12 months before the claim arose. Nothing in these terms limits liability that cannot be limited by law.
Governing law
These terms are governed by the laws of the State of Nevada, without regard to its conflict-of-law rules. This does not take away any protection the consumer law of the state you live in gives you.
Changes to these terms
We may update these terms; the effective date at the top shows when, and changes apply from that date.
